TERMS AND CONDITIONS

1. Our service

Our aim in providing our Services is to make life easier for you guys putting in the hard yards, bee keepers!

We provide an online Platform to introduce Members in various ways, and to allow Members to buy and sell New Zealand honey.

In providing the Honey for Coins Platform, we don't participate in the sale of honey or the transaction itself. We do not take ownership in any parts of the sale or items transacted nor do we act as a broker for either party.

1.1 Safety Commitment

Our Members will only use Honey for Coins Platform if they trust other Members and feel confident in the community of Members. While we can't verify Listings, we will step in where possible and take action. This could include issuing a warning, de-listing, disabling, or destroying an account, or referring matters to the relevant authorities.

Some examples of the kind of misuse we'd take action over are: illegal, stolen or unsafe Items; Listings that do not comply with New Zealand law or that infringe intellectual property rights; or harmful or offensive conduct. We may also limit your activities on our Site based on your off-site conduct, such as prior criminal convictions, insolvency, or any other conduct that puts our community or systems at risk.

You agree that we may disclose your personal information in accordance with our privacy policy, including your name and contact details, as well as any transactional records, site interactions or other relevant information, to the relevant authorities. We will not disclose any information in the public domain.

1.2 License to Transact

To enable you to use and enjoy our Services, we grant you a non-transferable and revocable licence to use our Platform.

We retain all of our intellectual property rights, including our rights in the software and source code used, to provide the Site and Services. You may not reproduce any works from any part of the Platform, or commercialise or on-sell any information obtained from using our Services.

2. Membership

Membership to use the site requires a monthly subscription fee of $9.99 New Zealand Dollars. To be a Member you must;

1. Be a New Zealand resident and at least 18 years of age.
2. Be in sound financial shape to pay for the subscription fees as they become due.
3. Complete the registration and verification process and provide true and up to date information.
4. Have an postal address that is not PO box for residential verification.

2.1 Membership Responsibilities

You are required to ensure all the relative account information is up to date and correct. From time to time we may choose to verify this.

You are held responsible for all the activities that occur on the Platform and off-Platform in relation to your account. This includes ensuring you login details are kept secure.

2.2 Communication

We may from time to time contact you using the account details provide with information that may be relevant or of interest to you. You can unsubscribe from this at any time.

2.3 Account termination

You may terminate your membership at any time. We will only ask that you pay for the last full month of subscription.

We may also terminate your account if we suspect there is malicious activity that may be detrimental to Members of the Honey for Coins Platform. We will do this for a reason and where practical communicate with you as to why this has occurred. We also reserve the right to cease communication with you.

3. Your general commitments as a Member

3.1 Honey for Coins is for New Zealand and New Zealand Residents only

Our Platform is set up to assist the domestic honey market with the transacting of New Zealand honey. This requires all transactions to occur between New Zealand Residents.

You must be located in New Zealand to list, buy, or sell honey on the Platform unless we approve you to use the Platform from overseas.

As a seller, you must offer buyers the option of paying for their purchase through at least one of; account with a New Zealand bank.

As a Member of this Platform you agree to comply with the Fair Trading Act 1986, Consumer Guarantees Act 1993 and Copyright Act 1994.

As a Member of this Platform you agree to the collection of data relation to the performance of the site, including a range of metrics.

4. Account Subscription

We believe our Services provide valuable information to both buyers and sellers in the New Zealand Industry. We work hard to provide this information and need help to continue doing so!

In response we have a basic site membership that is billed at $9.99/month at the end of each 30 day period. This will be charged via credit card. We may from time to time offer promotional deals on subscription.

Failure for the fee to be deducted from your nominated card may incur suspension of your account until the subscription fee is paid.

5. Selling

5.1 Sale Fee

Each sale conducted through the Platform incurs a 2% fee. The responsibility falls on the seller to pay the fee. This fee occurs once the buyer has purchased the listing through the site, committing to the purchase.

If the buyer commits to the purchase, but is unable to complete the purchase, payment of the commission fee then falls on the responsibility of the buyer.

Our fees are non-refundable. We understand that sometimes an auction may be completed on the site but the transaction may not take place for unforeseeable reasons. You may apply for a fee waiver. Each individual application will be reviewed on a case by case basis and approval of a fee way will be granted at our discretion.

By using our Services you agree to pay our fees.

From time to time we may change our fees. We will notify you about fee changes in advance.

Fees need to be paid within a week of the listing purchase date. Delays in fee payment will result in account suspension.

5.2 Goods and Services Tax

If you are a GST registered seller on the Platform, you are responsible for including your GST tax in the listing price.

5.3 Lawful and willing buyers and sellers

As a Member of the Platform, you agree to ensure all listings are accurate, complete, and representative of your listing. This includes the listing title, description, payment terms, and associated information. This is further discussed in Section 6.

You also agree that you will only list items that you own.

If we find that the listing was listing with inaccurate information leading to miss represent a purchase we may take action.

If you don't work with the buyer to ensure the prompt sale and dispatch of your listing we may also step in.

5.4 Freight

We encourage the Seller to provide regional information on the listing regarding the location of the product. It is the Buyers responsibility to ensure pay and organise freight. You agree to work with the Buyer to organise a time that is suitable to both Members for pick-up.

6. Accurate Listing Information

6.1 Product Weight

You agree to provide accurate information regarding the product weight. If a discrepancy in the weight is found between the Buyer and Seller, you agree to resolve this directly. You also agree that the product has been weighed using accredited scales no later than once year since calibration.

6.2 Test Results

For listings with time-dependent properties such as Methylglyoxal, we recommend you post results that are no older than 1 month from testing.

You agree that for any chemical properties that can be validated from a test report must be tested using as IANZ laboratory, and test reports must be IANZ accredited. This includes;

• 3in1 testing (DHA, MGO, NPA, HMF)
• Including forecasts derived from 3in1 testing
• Manuka 5 attributes (3-PLA, 2-MBA, 2-MAP, HPLA, Manuka DNA)
• Tutin
• Moisture
• Leptosperin
• C4 (Screen method)
• C4 (AOAC method)
• Glyphosate

In the case alternative test reports have been provided they may be rejected, or the auction closed. We may from time to time ask to verify this information.

6.3 Export Eligibility

You agree to provide truthful information about the eligibility of the honey for export. The listing must state both European (EU) and China (CN) eligibility. We may from time to time ask to verify this information.

7. Buying

You should only bid on an listing if you intend and have the means to purchase the listing in its entirety. If you place the winning bid on the listing, you are creating a legal contract where you and the seller are committing to completing the transaction.

Once a listing is sold, We will contact the seller requiring fee payment to our nominated account. Once the fee has been cleared, the buyer is provided with the seller details including address, payment details and listing-specific information.

If you don't pay for an item that you've agreed to purchase, and the seller complains to us we may take action. This could include a warning, account suspension or termination. We may not give you warning if this occurs. As the buyer, you are also responsible for covering the success fee if the sale is not completed.

We do not disclose the information of the buyer or seller on the Platform but may indicate the sales amount of listing info for promotional purposes.

7.1 Payment

We recommend sellers opt to use bank transfer as the preferred payment method.

7.2 Freight

You agree as a Buyer to organise and pay for the freight.

8. Disagreements and Resolution

8.1 With another Member

You agree to resolve any disputes you have with other Members directly. We may step in to help facilitate the resolution but we are not a party in the transaction between Member to Member transactions.

8.2 With us

If you have a dispute with us please contact us at info@honeyforcoins.co.nz and we will try to resolve with you. Our first instance will be without legal action, however if we cannot do so, either party can see any legal method these see practicable.

8.3 Service Disruption

We provide our Services to you on an as is basis, which means you agree to use our Services at your own risk. If our services were to become temporarily unavailable or decommissioned, we do not take any responsibility for the implications this may have on Members or listings.

8.4 Limited Liability

You agree to take responsibility for any loss, damage, or liability, either directly or indirectly related to the Platform, that results from the use of the Platform.

This includes;

• Incorrect information stated on listings.
• Breach of Membership commitments by Members.
• Loss, damage of product listed or related to listings on this site.

8. Change to terms and conditions

We may from time to time change our terms and conditions. We will generally give 2 week's notice notice to any change, but will always endeavour to notify you, at least via site announcement. You agree it is your responsibility to ensure you remain up to date on our terms and conditions. If you don't agree to any of the terms and conditions you must stop using our Services.

PRIVACY POLICY

At Honey For Coins, we are committed to protecting your privacy. We do not sell, trade, or rent your personal information to others. We may provide aggregate statistics about our customers, sales, traffic patterns, and related site information to reputable third-party vendors, but these statistics will include no personally identifying information.
